The Legal Standard for Premises Liability Claims in New York

To build a valid personal injury case following a serious fall, your legal team must establish that the property owner failed to meet their explicit legal responsibility under New York property laws. New York applies a unified standard of care across all types of real estate, focusing entirely on the foreseeability of danger rather than the old common-law categories of visitor status.

Under the landmark New York Court of Appeals ruling in Basso v. Miller (40 N.Y.2d 233), a property owner or lawful lessee owes a statutory duty to maintain their premises in a reasonably safe condition in view of all the circumstances, including the likelihood of injury to others, the seriousness of the injury, and the burden of avoiding the risk. This unified standard applies directly to commercial shopkeepers, residential landlords, and public facility managers across Bronx County.

To hold New York property owners legally responsible for your slip and fall injury, our slip and fall lawyer team must demonstrate that a specific hazard caused your accident and prove that the owner possessed notice of the danger.   Notice can be actual or constructive notice.  Actual notice means the property owner knew the defective condition existed or created the condition.  Constructive Notice means the defective condition existed for such a period of time that the property owner or landlord should have known about it.  Defective conditions include spilled water or liquid, snow and ice conditions, defective roadways or sidewalks.

This requires establishing at least one of the following legal elements:

  • Creation of the Hazard: The property owner, business manager, or their immediate employee directly caused the dangerous condition, such as mopping a commercial aisle and leaving wet floors without posting visible warning signs.
  • Actual Notice: The responsible parties possessed explicit knowledge of the hazard, such as a building superintendent receiving a written tenant complaint about a broken step or a leaking ceiling pipe, but failing to address it.
  • Constructive Notice: The dangerous condition existed on someone else’s property for a long enough period that a reasonable person engaged in standard maintenance inspections should have discovered and corrected it before an accident occurred.

Our experienced Bronx slip and fall lawyers work diligently from the very start of your personal injury case to uncover structural maintenance logs, examine sweep sheets, and extract surveillance data to establish clear notice and hold negligent property owners accountable.
